Terms of Service

1. Who you are contracting with

FranchiseTracker is operated as a sole proprietorship trading under the name FranchiseTracker. When these terms say "we", "us" or "our", they mean that business, and when they say "you" they mean the person or organisation using the service. Your agreement for the service itself is with us.

Payment is separate. Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. That means Paddle, not us, is the seller of record for your purchase, handles your payment details, charges applicable tax, and issues refunds. Your purchase is also subject to Paddle's buyer terms (opens in a new tab), which cover payment, billing, tax, cancellation and statutory withdrawal rights.

2. Accepting these terms

By creating an account or continuing to use FranchiseTracker, you agree to these terms. If you do not agree, please do not use the service.

You must be at least 18 years old and able to enter into a binding contract. The service is built for business use — for suppliers, contractors and service providers who sell to franchise operators — and you confirm you are using it in the course of a business rather than as a consumer, except where your local law says otherwise.

If you accept these terms on behalf of a company, you confirm you are authorised to bind that company, and "you" means that company.

3. What the service is, and what it is not

Franchise brands are required to publish a Franchise Disclosure Document. Those filings say how many new locations franchisees have committed to open, in which states, and who the current and former franchisees are. We read those public filings and turn them into something you can search.

Because of that, three things are always true:

• Every figure reflects the date it was filed. It is a commitment recorded on a particular day, not a prediction of when — or whether — a location will open.
• We do not guarantee accuracy or completeness. Filings contain errors, arrive late, and are sometimes ambiguous. We extract them carefully, but the service is provided as-is and you should verify anything you intend to rely on.
• Nothing here is advice. We do not provide legal, financial, franchise or investment advice, and the data should not be treated as any of those.

We may change, add or remove features, sources and coverage over time. If we make a change that materially reduces what a paid plan includes, we will tell subscribers before it takes effect.

4. Your account

You sign in either with your Google account or with a one-time code we email you. There is no password to remember, which means access to your email inbox is access to your account — keep it secure, and tell us promptly at support@franchisetracker.app if you believe someone else has reached your account.

An account is for one person. You are responsible for everything done through it. Please keep the details on your account accurate so we can reach you about billing and service changes.

5. Plans, billing and cancellation

A free account lets you browse filings and expansion signals. The Pro plan adds franchisee contact details and roster access, and is billed monthly.

• It renews automatically. Your subscription continues for successive one-month periods, and your payment method is charged at the start of each period, until you cancel.
• The first month may be free. When the offer is available, the free first month is limited to one per person. It converts into a paid monthly subscription at the normal price unless you cancel before it ends, and you will be told the price before you confirm. Taking a second free month — including through a second account — is a breach of these terms, and we may end the trial and bill the subscription immediately.
• You can cancel at any time, from your account page, in about as many clicks as it took to subscribe. Cancelling stops the next charge; your access continues to the end of the period you have already paid for.
• Prices can change. We will give you at least 30 days' notice by email before a change affects your subscription, so you can cancel first if you prefer.

Refunds are covered by our Refund Policy, which includes a 30-day window on your first paid charge and the statutory rights that apply where you live.

6. Fair use of roster unlocks

Subscribers can unlock 10 rosters per billing period. Unlocking a roster makes the franchisee contact details in that filing available to your account for as long as your subscription is active. The allowance resets at the start of each billing period and does not carry over.

The allowance exists so one subscription serves one business. If you need more, contact us at support@franchisetracker.app rather than opening additional accounts.

7. What you may and may not do

You may use the data to run your own business: to research brands, find operators, and approach them about your products or services.

You may not:

• Resell or redistribute the data. That includes republishing it, sharing your account, sublicensing it, or building a competing dataset or product from it.
• Scrape or bulk-extract it, whether by automated means, by circumventing the unlock allowance, or by any method other than the features we provide.
• Use it unlawfully, including for fraud, spam or harassment.
• Infringe intellectual property rights, ours or anyone else's.
• Interfere with the service, including probing or testing its security, introducing malware, or trying to reach data that is not yours.

Contacting people lawfully is your responsibility. The contact details in the service are business contact details taken from public filings. How you may use them is governed by the marketing, telemarketing, text-message, email and do-not-call rules that apply to you and to the person you are contacting. We do not provide consent on anyone's behalf, and we do not check your campaigns. Before you call, text or email anyone, make sure you are entitled to.

8. Intellectual property

The underlying filings are public documents and we claim no ownership of them. Everything we add — the extraction, the compilation, the structure of the database, the site, its design and its software — is ours, and these terms grant you a limited, non-exclusive, non-transferable right to use the service while your account is in good standing. Nothing more is transferred.

9. Suspending or ending access

We may suspend or end your access if:

• you materially breach these terms, including the fair-use and acceptable-use sections;
• a payment fails and is not resolved;
• we reasonably suspect fraud or a security risk to the service or its users; or
• we are required to by law.

Where it is reasonable to do so we will warn you first and give you a chance to put things right. You can stop using the service and close your account at any time by cancelling your subscription and emailing us.

10. Disclaimers

The service is provided "as is" and "as available". To the fullest extent permitted by law we disclaim all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the service will be uninterrupted, timely, secure or error-free, or that any figure in it is accurate or current.

11. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, nor for lost profits, lost revenue, lost business opportunities or lost data, even if we have been told such damages are possible. Our total liability arising out of or relating to the service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.

Nothing in these terms limits liability that cannot be limited by law, including liability for fraud.

12. Changes to these terms

We may update these terms as the service changes. When a change is material we will give notice — by email to account holders, or by a notice on the site — before it takes effect. Continuing to use the service after that means you accept the updated terms. The last-updated date at the foot of this page always tells you which version is current.

13. Governing law

These terms are governed by the laws of Israel, and the courts of Israel have exclusive jurisdiction over any dispute arising from them. This does not remove any protection your own local consumer law gives you where that law applies. Your payment is separately covered by Paddle's buyer terms (opens in a new tab).
